James Gatdet Dak under “serious torture” in Juba

Juba, November 3, 2016 (SSNA) — The Spokesman for the leadership of the Sudan People’s Liberation Movement/Army-In Opposition James Gatdet Dak has been handed over to South Sudan’s government after he was kidnapped at his house by Kenyan police and currently being tortured in a Juba jail, a government source familiar with events surrounding the deportation of top rebel Spokesperson has told the South Sudan News Agency (SSNA) Thursday.

The source confirmed to the SSNA that Nairobi did in fact gave Mr. Dak to Juba and that he is now being tortured, adding that South Sudanese government could kill the rebel spokesman.

“They handed over Gatdet to South Sudan. He is under serious torture as we speak. He is under serious situation…very bad and I think they will kill him,” the source said.

Reasons behind his kidnapping are unclear.

However, Dak was mysteriously picked up at his residence by Kenyan police Wednesday hours after he posted a statement on his Facebook profile supporting UN decision to fire Kenyan General who was the chief of the United Nations Mission in South Sudan (UNMISS).

The UN accused the dismissed General of failing to carry out his duties when South Sudanese government soldiers attacked UN personnel and killed civilians in July.

Our source also said some reports in Juba suggest that ‘dirty money’ has been used by Juba to get James Gatdet in an attempt to humiliate rebel leader Dr. Riek Machar.

    That is wrong by Kenyan government should not do that .whatever rebels did the wrong things in Kenyan. The Kenyan government should not do that because you don’t know about tomorrow.

  • One of my friend, who used to live in Kenya told me that, Kenyan people love money very much. They( Kenyan) can even sale their kids to you if they know that you can give them money. If you have the money, you can even assassinate their president, you would get him very quickly because you can bribe police and guards to open the way for you until you reach where the president is residing. What kind of people are these in the universe? Now, the deportation of Mr. Gatdet Dak is illegal. Kenya authority violated the international law. When we were fighting with Sudan government, for example, especially South Sudanese who migrated to the western world, if some of them made mistakes, they could not be deported to Sudan because western authority cannot violet the international law, even if Sudan government give them million of dollar, they would not accept to violet the international agreement. One of the reason why the west could not do that is a fact that they do not want their countries to be seen violating international agreement put down as a law that can be respected by any country in the world. Another reason could be shame, they do not want to be seen doing bad things that other countries would see it shame to be done. Now, kenyan Authority has violated the international agreement for love of money, which is shame for their country. Kenya should know that It is good to convent people reasonable than to convent people by given them money. To me, let our struggle continue. We must order our troop now to close down the source of money in South Sudan so that they will have no money to bribe our neighbours regions who love money like Kenyan Authority.

  • This is the worst mistake that the Kenyan government has ever committed in relation to South Sudan. One, they should not hand over and individual who ran away from his country for political reasons to his rivals. Secondly, dak entered Kenya with an American Passport and not South Sudanese one. Third, Kenya losses any legitimacy to mediate between SPLA and SPLA-IO as Kenya has openly taken Kiir’s side. Fourth, Kenyans citizens in the rebel held areas are in danger of revenge. Fifth, in Case Machar will one day return to power, Kenya will not enjoy the same good relations they have had with South Sudan. Sixth, Kenya has to explain to the US why they handed a US citizens to Juba etc. I do not see anything good Kenya gained by handing Dak to Kiir.

If this South Sudan government opposition spokeman has really kidnapped by s.sudan elements, then Kenyan government failed to protect him; If Kenyan government really sent this person back to s. Sudan where he will be persecuted, then kenyan government will be blamed for that; So, either situation Kenyan government is responsible in front of UN Charter and international community norms.

He has spoiled the relationship between the Kenyan citizens who are currently working in Juba and other parts of South Sudan with the South Sudanese who are under the rebels side. Secondly this is against the international law which means am not also safe to be in another country like Kenya. So please note that if they kill James Gatdek in Juba, all Kenya citizens in South Sudan will not be in peace.

  • This is political and moral blunder on the side of Kenyans. They have the right to ask him leave Kenyan territory with in a specific time line but not to arrest and hand him over to his political adversary of the South Sudan. Kenyan Civilians who would like to do business in south Sudan may be prime targets of reprisal. I suggest the Kenyan government work to secure his release in no time to rectify this terrible mistake.

    • Kenya has the right to expel anyone its not interested in. But not to arrest and hand such a person to his/ her enemy. South Sudan issues r seen as political difference out there but in fact they are tribal inside.
      Many South Sudanese understand this act as Kenya support for the Dinka.
      Its unfortunate that the action will cost Kenya money that its citizens were able to harvest in South Sudan as they are victim of revenge.
      Lossing job happens everywhere even in Kenya people are being fired from job but i dont understand why firing the genera is so painful to Kenya.

    In such circumstances one needs to critically read and observed the principle of International Humanitarian Law(IHL) or Refugee Law.

    I don’t think whether the Law and the conventions some people including UNHCR have been quoting are useful in this scenario because of the following:-
    1. Is James Gadet Dak an asylum seeker in Kenya or a Refugee? The Answer is NO. Because the law is clear that if you are a dual citizen, you must seek protection from the second country where you hold passport and Mr. James Gadet Dak is an American citizen,
    2.Mr. James Gadet went to Nairobi before the war broke out in Juba in J1, so can you seek protection before any persecution?
    3. According to Kenyan government, he was there as an individual (Lawful Resident) renting a house and without any registration with UNHCR.
    4. There is no fear of persecution in South Sudan since SPLM_IOs are here in Juba and they are not targeted.
    5. He does not have any right to participate in Kenyan politics. The oppositions in Kenya were supporting the move to remove the Commander which Gadet supported at his facebook page, therefore Kenya has right to deport him to his first country he holds the passport for involving in political affairs of Kenya.

    What I may suggest is that, South Sudan is already a first home to Mr. James and there is no more persecution on SPLM_IO as I may guess because there are IO members already in Juba and the government should in this case keep him safe and considered him like any other IO member in Juba or be pardoned by the President after legal proceedings against him if any or Staying of Criminal proceeding by theHon. Minister of Justice.
    Or otherwise when you celebrate my lost of job when I have accommodate you in my house and even if you are not the boss who fired me, I send you away or handed you to your father or mother.
